Generally, you need to obtain "opt in" permission from someone, to be able to send them marketing emails (newsletters, etc.). "Opt in" means they have to take an explicit action (such as checking a box) to give permission for you to email to them. Simply having an email address, contacting you with a question, or even ordering a product may not constitute permission. It is good practice, at the top of each newsletter, to remind the recipient that they signed up to receive such emails, and to provide an easy "one click" way to unsubscribe. This reduces the chance that you'll be blacklisted as a spammer. To be able to provide the date on which they gave permission (store it with customer data, not just that "they opted in") would be even better.
