a GPL violation from virtual hosting company

I've sent the letter to gpl-violations.org[rt.gpl-violations.org #15] long time ago. They, hiisp.com, is still offering compiled program to customers now. So I post it here.

Hi, all.

 

Sadly that I found another GPL violation in Taiwan. :(

 

hiisp.com is offering virtual hosting services for chinese users. I

recently get a request from my customer for moving the website from it

to another vender. I found that they( hiisp.com ) did compile the

famous PHP application, OSCommerce( http://www.oscommerce.com/ ), with

Zend Encoder( http://www.zend.com/ ) and offer the modified version

for customers to prevent customers leaving.

 

The modified version they offered which includes many other GPL

licenced contributions. I did publish an open letter for them(

http://www.osobiz.com/xoops/modules/news/a...php?storyid=102 )

which tell them the violation and I would try to transfer the

information here if they don't give good answers.

 

Their answers:

 

1. They didn't charge any fee for installing the modified version.

2. They didn't charge any fee through the package.

3. They didn't force customers setup their package.

4. They didn't compile all source code.

5. They compiled the source code for efficient.

 

The fact is... They didn't and don't want to offer the source code for

the modified version.

 

Any ideas??
