LOL @Joop, I got banned from that forum months ago. As a guest I can see the downloads section and download the files. It was there this morning, now it is not there.

Quote from Vger at oscommercproject.org

Quote

Harald Ponce de Leon has breached the confidentiality of legal documents between our respective legal counsels by posting partial contents of a letter to eCommerce Ventures Ltd on his forums.

Naughty Harald....

Great, this project is a better place when the am-egos (Rhea, Tony, Bobby etc) are no longer associated with it

That is indeed one step closer to victory! We are still waiting for a signed agreement to formerly close the settlement.

Not quite everything. While http://oscommerceproject.org and http://forums.oscommerceproject.org redirect to the new server, http://www.oscommerceproject.org is still visible. This might be an oversight on their part.

I'm sure that they will apply for trademark registration of their new name and the ® will be back when it is granted.

I wish them well in their efforts, though I have no plans to use their cart after this whole affair.

Hi All..

It seems ip21 are no longer representing Rhea Anthony / eCommerce Ventures Ltd. in this legal dispute. The offer to settle this dispute has not yet been signed by eCommerce Ventures Ltd. Our legal counsel are contacting Rhea Anthony directly to find out how she is proceeding with the matter.

Kind regards,

That is at least a bit strange.
Also the trademark is still registered at the IPO and it should not take that long to un-register it.

But because only a few people know what the terms of the settlement are only they can try to predict her next moves.

Maybe she is trying to find the million pounds from under het mattress.

@Harald

After this predicement if over it could be of benefit to others if you could write down the precedings and steps you and your lawyers took and and how and why to come to an settlement this case.

Ofcourse without the explicit terms in the agreement.

Someone else could find himself in this position in the future with his trademark or copyright infringement on his in good faith free open source software.

Personally, I think it might be slightly higher in elevation....

The one outstanding matter is that of our trademark. Part of the offer not accepted by Mr Ponce de Leon was to transfer it to his name. In place of that agreement we have decided to release it back to the IPO. This process will be started within the next 10 working days.

Thats what we wanted ;)

We have today advised Beck Greener that we are not prepared to continue negotiating on the form of a signed agreement with them and their client Mr Ponce de Leon.

Should we read in this that they think that by relinquising the trademark, removing the download and changing their forum name they can get away with it.

It sounds to me that they just took these actions so they can play inoccence in a possible pending court case.

'He, we gave it all back, what more do they want........'.
